Thank you for choosing AcumenSites! This refund and cancellation policy (“Refund and Cancellation Policy” or “Policy”) outlines the terms under which refunds and cancellations are processed. We value your trust and are committed to delivering high-quality services. Please review the Refund and Cancellation Policy carefully before subscribing to our services, products, or tools.

  1. Introduction
    1. For the purposes of this Policy, Acumen Technologies (SMC-PVT.) Limited, operating under the brand name AcumenSites, shall hereinafter be referred to as 'we,' 'us,' 'our,' or 'Company'.
    2. By accessing and using the tools, products, and services made available to you by us, you (hereinafter referred to as the "User" and may also be referred to as “user” or “client”) agree to comply with and be bound by this Refund and Cancellation Policy.
    3. The Company and the User shall each be referred to as a ‘Party’ and collectively as the ‘Parties’.
  2. Applicability

    By purchasing services, products, or tools from us, you engage in our “Service” and agree to be bound by this Policy, including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

  3. Refund Eligibility
    1. We understand that unforeseen circumstances may require a refund. Refund requests will be evaluated based on the following conditions:
      • Cancellation Before Service Commencement: If the client cancels the Service before any work has begun, they are eligible to request a full refund.
      • Cancellation During Early Stages (<50% Work Completed): If the client cancels the Service after work has commenced but before 50% completion, a 20% cancellation fee of the total Service cost will apply.
      • Cancellation During Advanced Stages (≥50% Work Completed): If the client cancels the Service after 50% or more of the work is completed, a 40% cancellation fee of the total Service cost will apply.
      • Unsatisfactory Performance: If the client is dissatisfied with the initial concepts, Service progress, or final delivery, a refund request may be reviewed on a case-by-case basis. We are committed to addressing and resolving any concerns before considering a refund.
      • Failure to Deliver: If we are unable to fulfill the agreed-upon Service within the specified timeframe, the client may request a full refund. Every effort will be made to resolve the issue before processing a refund.
    2. All refund requests will be evaluated solely at the discretion of Acumen Technologies (SMC-PVT.) Limited, and refunds will be granted only in cases deemed appropriate by the company, based on the specific circumstances of each request.
  4. Refund Process

    To request a refund, clients must submit a written request to refunds@acumensites.com, along with:

    • A detailed explanation of the refund request.
    • PKR Bank account details for fast refund processing (only local clients).
  5. Processing Timeline

    Refund requests will be reviewed within 1-2 business days.

    • For local clients, if approved, the refund will be processed and deposited into the provided PKR bank account within 3-5 business days.
    • For local clients, if approved, the refund will be processed and deposited into the original payment method within 7-15 business days.
    • For international clients, if approved, the refund will be processed and deposited into the original payment method within 7-15 business days.
  6. Non-Refundable Items

    Certain services and fees are non-refundable, including but not limited to:

    • Domain Registration Fees: Once a domain is registered, the associated fee is non-refundable.
    • Third-Party Expenses: Any costs incurred on behalf of the client, such as licensing or third-party integrations, are non-refundable.
    • Payment Processor Fees: Transaction fees applied by some payment processors may not be refundable.
  7. Force Majeure
    1. Neither the Company nor the User shall be liable for any delay or failure to perform its obligations under this Policy if such failure or delay is directly caused by circumstances beyond its reasonable control, including but not limited to acts of God, wars, riots, strikes, accidents, explosions, fires, shortages of labor or materials, labor disputes, government restrictions, equipment failures, acts of terrorism, epidemics, pandemics, cyber-attacks, regulatory changes, or any other unforeseen circumstances beyond the reasonable control of the affected Party (each, a “Force Majeure Event“).
    2. If a Party is affected by a Force Majeure Event, it shall:
      • Promptly notify the other Party in writing upon the occurrence of a Force Majeure Event.
      • Take all reasonable steps to mitigate its impact and resume performance as soon as practicable.
    3. If a Force Majeure Event continues uninterrupted for thirty (30) consecutive days, the non-affected Party may terminate this Policy by providing fourteen (14) days’ written notice to the affected Party.
  8. Modifications to this Policy

    This Refund and Cancellation Policy is effective as of March 25, 2025, and will remain in effect unless modified. Any future changes will take effect immediately upon being posted on this page. We reserve the right to update this Refund and Cancellation Policy at any time without any notice. Users are encouraged to review this Refund and Cancellation Policy periodically, as continued use of our tools, platform, products, or services after updates implies acceptance of the revised Refund and Cancellation Policy.

  9. Arbitration

    The Parties shall attempt in good faith to resolve any controversy or claim through senior level of management. If they are unable to do so within one (1) month, and regardless of the cause of action alleged, any dispute which is not resolved shall be referred to arbitration by a sole arbitrator appointed by mutual agreement of the Parties under the Pakistan Arbitration Act, 1940 as amended and failing such mutual agreement the arbitrator shall be appointed by the Court. Thereafter, the arbitral award shall be binding on the Parties. Each Party shall bear its own attorney’s fees and costs related to the arbitration. The arbitration shall take place in Bahawalpur, Pakistan, and the language of the proceedings shall be English or Urdu.

  10. Entire Understanding

    This Policy constitutes the entire understanding between the Parties and supersedes all prior communications, proposals, understandings, and agreements, whether written or oral, related to the subject matter herein.

  11. Governing Law and Disputes
    1. This Refund and Cancellation Policy is governed by the laws of the Islamic Republic of Pakistan.
    2. Subject to the arbitration provisions above, in relation to any legal action or proceedings arising out of or in connection with this Refund and Cancellation Policy, each Party irrevocably submits to the civil jurisdiction of the competent courts of law at Bahawalpur, Pakistan.
  12. Severability

    If a court of competent jurisdiction declares any provision in this Refund and Cancellation Policy invalid or unenforceable, such invalidity or unenforceability shall have no effect on the remainder of this Refund and Cancellation Policy which shall remain in full force and the invalid provision will subsequently be declared to be severed from this Refund and Cancellation Policy. If such invalidity or unlawfulness becomes known or apparent to either Party, then both Parties agree to negotiate promptly in good faith in an attempt to make appropriate changes and adjustments to achieve as closely as possible, consistent with applicable law, the intent and spirit of such invalid or unlawful provision.

  13. Assignments and Transfers

    The Parties acknowledge that they may be consolidated or amalgamated with, merged with or into, or acquired. Only in the event of such consolidation, amalgamation, merger or acquisition, the Parties shall be entitled to assign, novate, delegate, sub-contract, outsource, transfer, charge or otherwise dispose of all or any of its rights and responsibilities under this Refund and Cancellation Policy to the resulting entity or acquiring institution at any time without the prior consent of Parties.
